These Terms and Conditions ("Terms") govern the use of this website and the engagement of services provided by Senari ("we", "us", "our"), a bedroom interior design studio operating at Plaza Damas, Sri Hartamas, 50480 Kuala Lumpur, Malaysia. By using this website or engaging our services, you agree to these Terms. If you do not agree, please do not use the website or commission services.
1. Definitions
- "Services" refers to the design services offered by Senari, including the Bedroom Brief and Quiet Audit, Bedroom Documentation Package, and Sourcing and Placement Day.
- "Client" or "you" refers to any individual or entity that engages Senari for services or uses this website.
- "Agreement" refers to these Terms, together with any written service agreement or scope document signed between the parties.
- "Deliverables" refers to any written document, drawing set, sourcing summary, or other output produced by Senari in the course of service delivery.
- "Site" refers to this website.
2. Acceptance of Terms
By submitting an enquiry through this website or entering into a service agreement with Senari, you confirm that you are at least 18 years of age and have the legal capacity to enter into a binding agreement. If you are acting on behalf of a company or other legal entity, you confirm that you have the authority to bind that entity to these Terms.
3. Service Description
Senari provides interior design services focused on the bedroom, including the following:
- Bedroom Brief and Quiet Audit (RM 410): An on-site assessment of light, air, storage, and layout, producing a written brief, draft layout, and storage note.
- Bedroom Documentation Package (RM 2,250): Full design documentation including layout, joinery, lighting, finishes, soft furnishings schedule, and 3D views. Two revision rounds included.
- Sourcing and Placement Day (RM 1,180): Furniture, soft furnishings, and lighting sourcing in two budget bands, with shortlists, sample reviews, a placement visit, and written summary.
Services are available primarily within Kuala Lumpur and the Klang Valley. Projects outside this area may be considered on a case-by-case basis.
4. Client Responsibilities
You agree to:
- Provide accurate and complete information about the property and project scope at the outset
- Respond to requests for feedback or approvals within a reasonable time so as not to delay project delivery
- Ensure access to the property for any agreed on-site visits
- Not use this website for any purpose that is unlawful or that causes harm to Senari or third parties
- Not reproduce, distribute, or publish Deliverables beyond your own personal or household use without written consent from Senari
5. Intellectual Property
All Deliverables produced by Senari — including briefs, drawings, schedules, and sourcing summaries — remain the intellectual property of Senari until full payment has been received. Upon receipt of full payment, we grant you a non-exclusive licence to use the Deliverables for the specific project to which they relate.
Deliverables may not be modified and presented as original work by any third party, used for commercial publication, or shared in contexts that imply a design credit other than Senari, without our written agreement.
All content on this website, including text, design, and layout, is the property of Senari and may not be reproduced without permission.
6. Payment Terms
Fees for each service are stated in Malaysian Ringgit (RM). Payment terms are confirmed in writing at the point of service engagement. Standard terms are:
- A deposit of 50% of the service fee is payable upon agreement of scope
- The remaining 50% is payable prior to delivery of the final Deliverable or placement visit, as applicable
- Payment methods accepted include bank transfer to a Senari account, details of which will be provided in the service agreement
If payment is not received within 14 days of the due date, we reserve the right to pause service delivery until the outstanding amount is settled. All fees are quoted inclusive of applicable Malaysian taxes where required by law.
Cancellation: If you cancel after the deposit has been paid, the deposit is non-refundable. If we have completed more than 50% of the agreed scope at the point of cancellation, the full fee may be payable. We will confirm the position in writing at the point of cancellation.
7. Service Delivery Terms
- The scope of each service engagement is agreed in writing before work begins. No changes to scope will be actioned without written agreement and, where relevant, a revised fee.
- Timelines stated for each service represent typical durations and are not contractual commitments unless expressly stated in writing. Delays caused by the client's failure to provide timely access, feedback, or approvals are not attributable to Senari.
- Two revision rounds are included in the Documentation Package fee. Additional revisions beyond this will be quoted separately.
- The Sourcing and Placement Day is subject to availability of the sourced items at the time of selection. Senari does not accept liability for changes in stock availability, pricing, or lead times from third-party suppliers after shortlists have been agreed.
8. Confidentiality
We will not share images, layouts, or personal information relating to your project with third parties for marketing, portfolio, or any other purposes without your written consent. This applies during and after the engagement. Our standard practice is that client project details remain private unless you have agreed otherwise.
9. Disclaimers
Senari's services are provided as professional design advice and documentation. We do not carry out construction, structural work, electrical installation, or any regulated trade activity. Recommendations are provided in good faith based on the information available at the time of the engagement.
We make no representation that any contractor, joiner, or supplier recommended or sourced by Senari will perform to a specific standard. Our role in the sourcing service is to identify and shortlist options; the contractual relationship for any purchase or installation is between you and the relevant supplier or contractor.
This website and its content are provided for informational purposes and do not constitute professional advice beyond the scope of the services described.
10. Limitation of Liability
To the fullest extent permitted by Malaysian law, Senari's total liability to you in connection with any service engagement is limited to the total fees paid by you for that specific engagement.
We are not liable for indirect, consequential, or incidental losses arising from the use of our services, including but not limited to loss of use, loss of property value, or decisions made by contractors on the basis of our documentation.
Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, or any other liability that cannot be excluded by Malaysian law.
11. Indemnification
You agree to indemnify and hold harmless Senari, its team members, and representatives from any claims, losses, or expenses (including legal costs) arising from your breach of these Terms, your misuse of any Deliverable, or any false or misleading information you have provided in connection with a service engagement.
12. Termination
Either party may terminate a service engagement by giving written notice. If Senari terminates due to non-payment or breach by the client, any fees due for work completed to date become immediately payable. If you terminate for any reason after work has begun, the deposit is forfeited and additional fees may apply proportional to work completed.
Sections relating to intellectual property, confidentiality, limitation of liability, and dispute resolution survive termination of any service agreement.
13. Dispute Resolution
These Terms are governed by the laws of Malaysia. In the event of a dispute, both parties agree to attempt to resolve it informally by direct communication in the first instance.
If informal resolution is not possible within 30 days, disputes shall be referred to mediation before any formal legal proceedings are commenced, unless either party requires urgent injunctive relief. Any unresolved dispute shall be subject to the jurisdiction of the courts of Malaysia, with proceedings to be conducted in Kuala Lumpur.
14. General Provisions
- Entire Agreement: These Terms, together with any written service agreement, constitute the entire agreement between the parties regarding the subject matter.
- Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions continue in full force.
- Waiver: Failure to enforce any provision of these Terms does not constitute a waiver of the right to enforce it in the future.
- Assignment: You may not assign your rights or obligations under these Terms without our prior written consent. We may assign our rights to a successor in the event of a business transfer.
- Notices: Any formal notice required under these Terms should be sent by email to [email protected] or by post to the studio address below.
15. Changes to These Terms
We may update these Terms from time to time. The revised version will be published on this page with an updated effective date. For active service engagements, the Terms in force at the time the service agreement was signed apply for the duration of that engagement.
